Please read these Terms and Conditions ("T&Cs", "Terms", "Terms and Conditions") carefully before using the justpleachy.com website (the "Service") operated by Just Pleachy ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Purchases

You are encouraged to familiarise yourself with your rights contained within the Sale of Goods Act 1979, Unfair Contract Terms Act 1977 and the Unfair Terms in Consumer Contracts Regulations 1999.

In accordance with our Plant Health Professional Operator registration (CRN: 147706), we sell to consumers (final users) for personal use in the UK only. Strictly not for resale. 

If you wish to purchase any product or service made available through the Service ("Purchase"), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.

You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete. You expressly agree that Just Pleachy is not responsible for any loss or damage arising from the submission of false or inaccurate information.

By submitting such information, you grant us the right to provide the information to third parties for purposes of facilitating the completion of Purchases.

We reserve the right to refuse or cancel your order at any time for certain reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons. You expressly agree that Just Pleachy cannot accept any liability for loss or damage arising out of such cancellation.

We reserve the right to refuse or cancel your order if fraud or an unauthorised or illegal transaction is suspected.

Purchases with Planting Service

Our planting services are provided by Harrod Outdoors Limited. Their full terms of service, including the most up-to-date policy regarding cancellation fees, are available here: Refund Policy and Harrod Outdoors Terms of Usage

The planting team will carry out work to a high standard based on the conditions presented on the day. However, it is the customer’s responsibility to ensure that the planting site is suitable, safe and prepared in advance. This includes making sure the area is clear, level, free of weeds, has adequate drainage, and contains good quality soil. The customer must ensure the planting area is free from hidden hazards and that the location of any underground services is identified and clearly marked before work starts, including (without limitation) gas, electricity, water, drainage, telecoms, irrigation systems, septic tanks, soakaways, and any private pipework or cabling. In addition, any unrecorded, non standard, shallow, or privately installed services must be disclosed to the team in advance. If the customer is unsure, they must arrange a professional service search or utility check before the planting date.

The planting team may stop work immediately if they believe there is a risk to people, property, or services. Just Pleachy cannot accept responsibility or liability for damage to underground or concealed services where the customer has not provided accurate information, clear markings, or safe working conditions. If services are struck or suspected to have been struck, work may be paused immediately and any additional visits required as a result will be chargeable. If tree stumps are found in the planting area, they will need to be removed before planting. Please see the section below for more detail.

Any soil we dig out of the holes will need to be redistributed elsewhere in your garden. Typically, this is mixed with compost and spread evenly along a border. However, if we’re planting into a lawn rather than a border, you’ll need to let us know where the surplus soil should go, or arrange for it to be removed from site, as we’re unable to take soil away with us.

If the team is presented with challenging conditions, customers acknowledge that the planting team may raise concerns about site suitability, including but not limited to waterlogging, poor drainage, compacted soil, the presence of underground services, or tree stumps. Customers will be given the opportunity to ask questions or request a delay in planting.

By choosing to proceed with planting after any concerns have been raised, the customer confirms they understand the risks identified and accepts that the work will be carried out based on the conditions present on the day. In these circumstances, the customer accepts responsibility for any outcomes arising from the site conditions, and Just Pleachy cannot be held liable for any loss, damage, or failure arising from those conditions.

Tree Stump Removal Policy

All existing tree stumps must be fully removed before planting. Stumps can significantly delay work, cause damage to equipment, and affect the quality of planting. If stumps are discovered during planting and were not previously identified, the following charges will apply for removal:

• Stumps up to 10cm diameter: £50 per stump
• Stumps between 11–20cm diameter: £150 per stump
• Stumps between 21–30cm diameter: £300 per stump

Larger stumps typically require specialist equipment such as stump grinders or diggers and will therefore be priced individually (from £500+ POA). In rare cases, the team may recommend repositioning the planting area instead of attempting removal.

To avoid delays or additional charges, we strongly advise customers to ensure all stumps are removed by a qualified professional before the planting team arrives on site.

Non-Refundable Scenarios

No refunds will be issued once the planting service has started unless required by law or where Harrod Outdoors is at fault. Similarly, if our team arrives on site and cannot proceed due to site conditions that prevent planting, such as unremoved or unmovable tree stumps, poor access, unsuitable ground conditions, or other unforeseen obstacles, no refund will be issued. In these cases, customers may choose to reschedule the work once the issue has been resolved, and additional costs may apply.

Planting Conditions

In all cases, the work will be completed with reasonable care. This does not imply any guarantee or warranty regarding the outcome or long-term performance of the trees.

Just Pleachy may offer general guidance and support following planting. However, the day to day care, maintenance, and monitoring of the trees remains the sole responsibility of the customer. This includes, but is not limited to, appropriate watering based on weather and soil conditions, feeding, pruning, drainage management, and protection from environmental stress or pests.

As with all orders, Just Pleachy cannot accept responsibility or liability for any issues arising after planting. Please refer to the sections "No Guarantee or Warranty" and "Aftercare Responsibility" for further details.

Post-Planting Changes

Trees and plants are living products and, as such, their appearance and position may change over time due to natural factors including the time of year, individual growth patterns, soil type, weather conditions, moisture levels, and ground movement.

Trees within the same row may establish at different rates and develop unevenly, with variations in growth, density, and overall appearance. These natural differences are normal and expected.

The ground may settle, shift, or become compacted after planting, particularly in clay or moisture-retentive soils. 

Any measurements, observations, or photographs taken some time after planting do not necessarily reflect the original planting position or conditions at the time of installation. Natural changes should be expected as trees establish, settle, and mature.

Delivery Delays

Whilst every effort is made to keep to scheduled delivery dates, please note that, as stated in our delivery policy, we are not liable for delays beyond our control. These include (but are not limited to) shipping delays, supplier availability, driver illness, bank holidays, and weather conditions.

For this reason, we are unable to guarantee delivery in time for any gardeners you may book to plant trees or plants purchased from us and we cannot accept responsibility for the cost of any gardeners or other professionals booked to plant or otherwise attend to any trees, plants or other items ordered from us.

All of our potted trees will happily thrive for a few weeks in their pots as long as they are kept upright and well watered, so if you need to book a gardener, the trees will be able to wait a few weeks for the gardener to plant them.

Supply Chain Disruption or Grower Failure

In the unlikely event of a supply chain disruption, grower failure, or species-related outbreak that prevents us from fulfilling your order as planned, we will notify you as soon as possible.

Please allow up to 90 days for us to source and deliver trees of a similar size, quality, and specification. Every effort will be made to match your original order as closely as possible. If a suitable alternative cannot be supplied within this timeframe, you will be offered a full refund.

This clause applies only to circumstances genuinely beyond our control, such as supplier insolvency, stock failure, plant health issues, or government restrictions on plant movement. In all cases, communication and transparency will remain our priority.

No Guarantee or Warranty

Perishable goods are not covered by any guarantee or warranty. We do not offer a plant guarantee because plants can deteriorate rapidly without proper care. Numerous factors beyond our control, such as environmental conditions, pests, soil quality, watering practices, and aftercare can impact plant health.

For a limited time, Just Pleachy worked with Harrod Outdoors to offer a 24-month Planting Guarantee on planting service orders placed between 1st March 2024 and 8th August 2024. This guarantee, provided by Harrod Outdoors Limited, applied only to plants that were planted by Harrod Outdoors. Please note that this guarantee does not cover any planting service orders placed after 9th August 2024.

Aftercare Responsibility

The responsibility for the ongoing care and maintenance of your plants rests with you, the customer. This includes regular watering, feeding, pruning, and monitoring of site conditions. While we are happy to offer general guidance and resources, we cannot be held responsible for any issues that arise due to insufficient aftercare, unsuitable planting conditions, or failure to follow advice.

No Advice and Limitation of Liability

Our team provides general information to assist with your decision-making, and on each of our pleached tree pages, you'll find links to the RHS for their helpful guide and more details about each species. We also offer a comprehensive care guide titled "The Complete Guide to Pleached Trees." However, we do not survey your site or are able to provide specific advice on the suitability of tree types or species for particular purposes, locations, or individual circumstances. All decisions regarding the placement, suitability, and maintenance of trees are the sole responsibility of the buyer.

It is your responsibility to ensure that the intended location and prevailing weather conditions are suitable for the chosen tree and to confirm any planning or legal requirements with the relevant authorities. While our website articles and guides are designed for general information for UK residents, they should not be relied upon as a substitute for professional or legal advice.

Just Pleachy assumes no liability for any decisions made based on the information provided on our website, in our guides, or by our team. We cannot be held responsible for any planning issues, legal implications, or unsuitability of the trees chosen by the buyer. You are advised to seek independent legal or professional advice if you have specific questions or concerns.

By placing an order, you acknowledge and accept that Just Pleachy will not be liable for any loss, damage, or legal consequences arising from the purchase, placement, or use of trees in your specific circumstances.

Pet Safety Disclaimer

Our pet-friendly range includes species commonly regarded as non-toxic, based on guidance from sources such as the Royal Horticultural Society (RHS) and the Horticultural Trades Association (HTA) Guide to Potentially Harmful Plants. This classification is provided for general guidance only.

No plant can be guaranteed completely safe if ingested. The consumption of any plant material may result in vomiting, gastrointestinal upset, or other adverse reactions in animals.

Just Pleachy Ltd makes no representations or warranties regarding the safety of any plant for pets and accepts no liability for any injury, illness, or adverse effects arising from the use, presence, or ingestion of any plants supplied.

Customers are solely responsible for ensuring that all plants are suitable for their individual pets, garden conditions, and intended use, and should seek professional veterinary advice where appropriate.

Availability, Errors and Inaccuracies

We are constantly updating our offerings of products and services on the Service. The products or services available on our Service may be mispriced, described inaccurately, or unavailable, and we may experience delays in updating information on the Service and in our advertising on other websites. You expressly agree that any such offer of a product or service does not constitute a legal offer capable of attracting legal consequences.

We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice. Section "Availability, Errors and Inaccuracies" is without prejudice to existing statutory rights.

Contests, Sweepstakes and Promotions

Any contests, sweepstakes or other promotions (collectively, "Promotions") made available through the Service may be governed by rules that are separate from these Terms. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy. If the rules for a Promotion conflict with these Terms and Conditions, the Promotion rules will apply. The terms and conditions of any other "Promotions" are independent of this agreement.

The Service and its original content, features and functionality are and will remain the exclusive property of Just Pleachy and its licensors. The Service is protected by copyright, trademark, and other laws of both the United Kingdom and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Just Pleachy.

Just Pleachy has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites or services. You further acknowledge and agree that Just Pleachy shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such websites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

Termination

We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will cease immediately.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Indemnification

You agree to defend, indemnify and hold harmless Just Pleachy and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.

Limitation Of Liability

In no event shall Just Pleachy, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorised access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Just Pleachy its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

Exclusions

Without limiting the generality of the foregoing and notwithstanding any other provision of these terms, under no circumstances will Just Pleachy ever be liable to you or any other person for any indirect, incidental, consequential, special, punitive or exemplary loss or damage arising from, connected with, or relating to your use of the Service, these Terms, the subject matter of these Terms, the termination of these Terms or otherwise, including but not limited to personal injury, loss of data, business, markets, savings, income, profits, use, production, reputation or goodwill, anticipated or otherwise, or economic loss, under any theory of liability (whether in contract, tort, strict liability or any other theory or law or equity), regardless of any negligence or other fault or wrongdoing (including without limitation gross negligence and fundamental breach) by Just Pleachy or any person for whom Just Pleachy is responsible, and even if Just Pleachy has been advised of the possibility of such loss or damage being incurred.

Governing Law

These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is made we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the service.
